Terms of Service

1. Who You Are Contracting With

These Terms of Service ("Terms") constitute a legally binding agreement between you and My Lengua Education, a sole proprietorship owned and operated by Chirag Malik, based in Hyderabad, Telangana, India ("we", "our", "us"). The trade name used for this platform is Lingaso. By accessing or using any Lingaso website or service (collectively, the "Service"), you agree to these Terms. 2. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18 (or the applicable age of majority in your jurisdiction), you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Description of Service

Lingaso provides Spanish language learning resources including, but not limited to, a vocabulary application and an AI-powered Spanish writing analyser tool available at languagewritinganalyser.lingaso.com. Features and availability may change over time.

4. User Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to notify us immediately at hi@mylengua.com of any unauthorised access to your account.
• You are responsible for all activity that occurs under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful or fraudulent purpose.
• Reverse-engineer, decompile, or attempt to derive the source code of any part of the Service.
• Scrape, copy, reproduce, or redistribute any content without express written permission.
• Upload or transmit malicious code or interfere with the Service's infrastructure.
• Violate any applicable local, national, or international law or regulation.

6. Intellectual Property

All content within the Service — including vocabulary data, feedback models, example sentences, UI design, and branding — is owned by or licensed to My Lengua Education and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial learning purposes only. You may not reproduce, distribute, modify, or create derivative works without our written permission.

7. Payments & Billing

• Payment processor: All payments are processed by Razorpay Software Private Limited, a payment aggregator regulated by the Reserve Bank of India. By making a purchase, you also agree to Razorpay's terms of service and privacy policy.
• Pricing: All prices are displayed clearly before purchase. Prices are inclusive of applicable taxes where required. We reserve the right to change prices with reasonable advance notice.
• Billing: Subscriptions, where offered, will auto-renew at the end of each billing period unless cancelled before the renewal date.
• Invoices: A payment confirmation will be sent to your registered email address after each successful transaction. GST-compliant invoices are available on request at hi@mylengua.com.

8. Cancellations & Refunds

In accordance with the Consumer Protection Act, 2019 (India) and applicable consumer protection laws, the following refund policy applies:

• Subscription cancellation: You may cancel a subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the period ends. No partial refunds are issued for unused time within a billing cycle.
• Refund eligibility: You may request a full refund within 7 days of purchase if the Service did not function as described. Requests must be submitted to hi@mylengua.com with your order ID and a description of the issue.
• Non-refundable situations: Refunds will not be issued if you have substantially used the Service during the period, if the request is made after 7 days of purchase, or if the issue is caused by factors outside our control (e.g. your device, internet connection).
• Processing time: Approved refunds will be processed within 7–10 business days and credited to your original payment method via Razorpay.

9. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described therein.

10. Third-Party Services

The Service uses third-party AI providers to generate writing feedback, and Razorpay for payment processing. We are not responsible for the independent practices of these third parties. Your use of their services is subject to their respective terms and privacy policies.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. AI-generated writing feedback is provided for educational guidance only and does not constitute professional examination advice. We do not warrant that the Service will be uninterrupted, error-free, or that feedback will guarantee any particular exam result.

12. Limitation of Liability

To the maximum extent permitted by applicable law, My Lengua Education and Chirag Malik shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid to us in the 3 months preceding the claim. Nothing in these Terms limits liability for fraud or death/personal injury caused by negligence.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms shall first be attempted to be resolved amicably by contacting us at hi@mylengua.com. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India. If you are a consumer in the EU/EEA/UK, you retain the benefit of any mandatory consumer protection provisions in your country of residence and may access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.

15. Changes to Terms

We may modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or a notice on the website. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

16. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Lengua Education regarding the Service.
